1. Overview

These Terms of Service (“Terms”) govern your access to and use of BandForge (the “Service”), operated by IP Pavlushkin Alexander (Individual Entrepreneur, registered in the Kyrgyz Republic), trading as BandForge (“we”, “us”, or “BandForge”).

The Service is accessible at ielts.linguo.me and related pages on linguo.me.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Product

BandForge is an AI-powered IELTS Writing Task 1 coaching tool designed to help you build the specific skills needed to improve your IELTS Academic Writing band score.

What you get:

• Isolated skill drills targeting individual IELTS Writing criteria
• Essay practice with per-criterion AI feedback
• Skill progress tracking and a personalised skill map
• Timed writing simulations
• Model answers and vocabulary support

What BandForge is NOT:

• BandForge does not provide official IELTS scoring. Band score estimates are approximate and generated by AI.
• BandForge is not affiliated with, endorsed by, or connected to the British Council, IDP, Cambridge Assessment, or any official IELTS body.
• IELTS is a registered trademark of University of Cambridge ESOL, the British Council, and IDP Education Australia. BandForge is an independent educational product.

3. Access & Billing

• Access period: 12 months from the date of purchase.
• After 12 months: Your access expires. You may purchase another 12-month period at the then-current price.
• Free features: Some features may be available without payment; we reserve the right to change what is included in the free tier at any time.

4. Payments

All payments are processed by Paddle.com Market Limited (“Paddle”) as our Merchant of Record. Paddle handles:

• Charging your payment method
• Sales tax / VAT calculation and remittance
• Payment compliance and fraud prevention
• Issuing invoices and receipts

When you make a purchase, you are transacting with Paddle, not directly with BandForge. Your purchase is subject to Paddle’s buyer terms: https://www.paddle.com/legal/terms.

5. Refund Policy

We offer a 3-day money-back guarantee, no questions asked.

• You may request a refund within 3 days of your purchase date.
• To request a refund, email support@linguo.me or contact Paddle buyer support at https://paddle.net.
• Refunds are processed by Paddle to your original payment method.
• Processing times depend on your payment provider (typically 5–10 business days).

6. Accounts

• Registration is available via email/password or Google login.
• Only one account per person is allowed.
• You are responsible for keeping your login credentials secure.
• You may delete your account at any time via the app. Upon deletion, your personal data will be removed from active systems in accordance with our Privacy Policy.
• We may suspend or terminate accounts that violate these Terms.

7. Acceptable Use

You agree not to:

• Harass, abuse, or harm others through the Service.
• Submit hateful, obscene, or unlawful content.
• Attempt to reverse engineer, copy, scrape, or exploit the Service’s code, AI models, prompts, or infrastructure.
• Perform security testing or penetration testing without our written permission.
• Misrepresent AI-generated feedback as official IELTS scores or certified results.
• Use the Service for any purpose other than personal IELTS preparation.
• Create multiple accounts to circumvent access limits or policies.

8. AI Disclaimer

• Feedback, band score estimates, and suggestions are generated by artificial intelligence using third-party providers (such as OpenAI, Google Gemini, and Anthropic) as well as our own models. The specific models and providers may change over time.
• Band score estimates are approximate and do not represent official IELTS scoring.
• AI outputs may contain errors or inaccuracies. You should not rely on them as a guarantee of any exam result.
• BandForge is an educational tool. Your exam preparation decisions and outcomes are your own responsibility.
• We continuously work to improve the accuracy and usefulness of AI feedback, but we make no warranty regarding the precision of scores or recommendations.

9. Intellectual Property

• Our content: All BandForge materials — including drills, model answers, prompts, skill maps, and instructional content — are proprietary and licensed for personal, non-commercial use only. You may not reproduce, distribute, or sell our content.
• Your content: You grant us a worldwide, non-exclusive, revocable licence to process, store, and analyse any writing you submit, solely to provide the Service (generate feedback, track your progress, and improve the product).
• AI-generated content: Feedback and model answers generated by AI are provided “as is” without warranty of accuracy or fitness for any purpose.

10. Service Availability & Changes

• The Service is provided “as is” and “as available” without any warranty of any kind, express or implied.
• We may impose fair use limits to maintain system stability.
• We may modify, suspend, or discontinue parts of the Service at any time. If we discontinue the Service entirely during your paid access period, we will provide a pro-rata refund for the unused portion.
• We may update these Terms at any time. The latest version will always be available at /terms. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• BandForge is provided without warranties of any kind.
• We will not be liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Service.
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

12. Governing Law

These Terms are governed by the laws of the Kyrgyz Republic. Any disputes arising from or related to these Terms or the Service will be submitted to the courts of the Kyrgyz Republic.
